Self-Petition Green Card

Self-Petition Green Cards are granted to qualified individuals who may apply without family or employer sponsorship. These foreign nationals may enter, live, and work in the United States because they have extraordinary abilities or skills that are in the U.S. national interest. These abilities or skills may change periodically, so consult with JCL Immigration Attorneys in Scottsdale, Arizona, for the latest State Department guidance and details.

EB-1A – Individuals with Extraordinary Ability

The EB-1A Green Card is for foreign nationals who demonstrate extraordinary ability in their field and wish to work in the United States. Qualifying areas can be science, arts, education, business, or athletics. Similar to an O-1 Work Visa, petitioners must provide documentary evidence proving outstanding achievements that have earned “sustained national or international acclaim.” General Details:
^
Applicants must demonstrate extraordinary ability in the sciences, arts, education, business, or athletics by providing evidence of sustained national or international acclaim.
^
Applicants must wish to enter the United States to continue work in the area of extraordinary ability.
^
The applicant’s entry into the U.S. must substantially benefit the U.S.
Extraordinary ability means a level of expertise indicating that the individual is one of that small percentage who has risen to the very top of the field of endeavor. Although the EB-1A allows self-petition, it does not mandate it. Applicants who have employers may ask the employer to submit the EB-1 petition.

Requirements for the EB-1A Green Card

A petition for an alien of extraordinary ability must be accompanied by evidence that the alien has sustained national or international acclaim and that his or her achievements have been recognized in the field of expertise. The individual must provide at least three forms of documentation, which can include:
^
Documentation of nationally or internationally recognized prizes or awards for excellence in the field of endeavor.
^
Documentation of membership in associations in the field for which classification is sought, which require outstanding achievements of their members, as judged by recognized national or international experts in their disciplines or fields.
^
Published material in professional or major trade publications or major media about the individual relating to the individual’s work in the field for which classification is sought.
^

Evidence of the individual’s participation on a panel, or individually, as a judge of the work of others in the same or in an allied field of specialization to that for which classification is sought.

^
Evidence of the individual’s original scientific, scholarly, or business-related contributions of major significance in the field.
^
Evidence of the individual’s authorship of scholarly articles in the field, professional journals, or other major media.
^
Evidence that the individual has been employed in a critical or essential capacity for organizations and establishments that have a distinguished reputation.
^
Evidence that the individual has either commanded a high salary or will command a high salary or other remuneration for services, evidenced by contracts or other reliable evidence.
